Terms of Service

HT Advanced Solutions Group (Pty) Ltd T/A Giftips SA · Effective: 1 March 2026

Please read these Terms of Service ("Terms") carefully before placing an order or using the website giftips-sa.co.za ("Website"). By accessing the Website, requesting a quotation, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Definitions

"We" / "Us" / "Our" refers to HT Advanced Solutions Group (Pty) Ltd T/A Giftips SA. "You" / "Customer" refers to the individual, company, or other legal entity placing an order or enquiry. "Branded Products" means merchandise on which your artwork, logo, or branding is applied. "Custom Order" means any order requiring branding, customisation, or bespoke production. "Unbranded Products" means stock items supplied without any branding applied. "Artwork" means any logo, design, image, or file you supply for branding purposes.

2. Our Services

Giftips SA supplies branded corporate merchandise, promotional products, and related services (including digital design mockups, print management, and logistics coordination) to businesses and individuals throughout South Africa. The majority of our products are custom-made to order — they are produced or branded specifically for each customer according to their artwork and specifications, and are therefore subject to the terms governing custom and special-order goods under the Consumer Protection Act 68 of 2008 ("CPA").

3. Quotations and Pricing

3.1 All quotations are provided in South African Rand (ZAR) and are inclusive of VAT at the prevailing rate (currently 15%) unless expressly stated otherwise.

3.2 Prices displayed on the Website are the base unit price for the blank/unbranded product and do not include branding charges, setup fees, delivery, or VAT unless expressly stated. A full itemised quotation will be provided before any order is confirmed.

3.3 Quotations are valid for 14 calendar days from the date of issue. After this period, prices are subject to change due to supplier pricing, exchange rate movements, or stock availability.

3.4 Quantity-tier pricing is available on most products. Unit prices decrease as order quantities increase. The quoted price applies to the quantity specified on the quotation.

3.5 We reserve the right to correct pricing errors at any time before production commences. You will be notified of any correction and may cancel the order without penalty.

4. Orders and Acceptance

4.1 An order is placed when you accept a quotation (via email, WhatsApp, or online checkout) and provide the required deposit or full payment.

4.2 We reserve the right to decline any order at our discretion, including where stock is unavailable, your artwork does not meet production requirements, or your requested delivery date cannot be met. If we cannot fulfil your order, you will receive a full refund of any amount paid.

4.3 Production begins only after: (a) full payment or agreed deposit is received; AND (b) you have reviewed and approved the free digital mockup we provide. We will not commence branding before both conditions are met.

4.4 Any changes requested after mockup approval may incur additional costs and revised lead times. Material changes (different product, significantly different branding) may require a new quotation.

5. Payment Terms

5.1 New customers are required to pay 100% of the order value (including branding and delivery) before production commences.

5.2 Established corporate account holders may be offered 50% deposit on order confirmation and 50% balance before dispatch, subject to a signed account agreement.

5.3 Payment methods accepted: EFT (Electronic Funds Transfer) to our nominated bank account. Payment gateway (credit/debit card) options may be available via the Website. Cash on delivery is not available.

5.4 Tax invoices will be issued upon payment confirmation and are issued under the name HT Advanced Solutions Group (Pty) Ltd T/A Giftips SA, VAT No. [VAT_NUMBER].

5.5 All payments must be in South African Rand. We do not accept payments in foreign currency.

6. Artwork and Intellectual Property

6.1 By submitting artwork for branding, you confirm that you own the intellectual property rights in that artwork or are duly authorised to use it, and that its use does not infringe any third party's rights.

6.2 You indemnify Giftips SA against any claims, losses, or damages arising from the use of artwork you supply.

6.3 We will not produce any order that includes artwork which is, in our reasonable opinion, defamatory, infringing, obscene, or unlawful.

6.4 Digital mockups created by us remain the property of HT Advanced Solutions Group (Pty) Ltd and are prepared specifically for your order review — they may not be used for any other purpose without our written consent.

6.5 All original website content, copy, and design elements on giftips-sa.co.za are the intellectual property of HT Advanced Solutions Group (Pty) Ltd and may not be copied or reproduced without permission.

7. Product Descriptions and Accuracy

7.1 We take reasonable care to ensure product descriptions, images, and specifications on our Website are accurate. However, actual colours may vary slightly from on-screen representations due to monitor calibration differences and dye-lot variation.

7.2 Product photography is provided by our suppliers and may show branding by other companies for illustration purposes only. Your mockup (step 3 of our order process) will show your actual branding before production begins.

8. Lead Times and Delivery Commitments

8.1 Quoted lead times begin from the date of mockup approval, not the date of payment.

8.2 We only commit to a delivery date if we have explicitly confirmed in writing (email or WhatsApp) that we can meet it. Our Deadline Guarantee means we will decline an order rather than accept it and deliver late.

8.3 Lead times may be affected by supplier stock availability, public holidays, courier delays, or force majeure events. We will notify you promptly of any anticipated delay.

8.4 Delivery charges are quoted separately and vary based on the order weight, dimensions, and destination. We use third-party courier services and are not liable for delays caused by the courier, provided we have dispatched your order on time.

9. Cancellations

9.1 Before mockup approval: You may cancel your order for a full refund of any amount paid, less any artwork preparation fees already incurred. Cancellation must be communicated in writing.

9.2 After mockup approval but before production commences: A cancellation fee of up to 25% of the order value may apply to cover sourcing, design, and preparation costs already incurred.

9.3 Once production has commenced: The order cannot be cancelled and no refund will be issued, as the goods are being produced specifically to your specifications. This is in accordance with Section 17(6) of the CPA, which excludes custom-made or special-order goods from the general right of cancellation.

10. Limitation of Liability

10.1 To the maximum extent permitted by applicable law, our total liability to you arising from or related to a specific order shall not exceed the amount paid by you for that order.

10.2 We will not be liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of revenue, loss of business opportunity, or reputational damage arising from delayed delivery or product defects — except to the extent such liability cannot be excluded by law.

10.3 Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by law.

11. Consumer Protection Act Compliance

11.1 Where the CPA applies, you retain all rights afforded to you under that legislation. Nothing in these Terms limits or excludes your rights under the CPA.

11.2 The CPA Section 56 implied warranty of quality (6 months) applies to defective goods. Please refer to our Return & Refund Policy for the procedure to raise a defect claim.

12. Website Use

12.1 You may use our Website only for lawful purposes and in a manner that does not infringe the rights of others.

12.2 We reserve the right to restrict or terminate access to the Website at our discretion. We do not warrant that the Website will be available at all times without interruption.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from these Terms or an order shall be subject to the exclusive jurisdiction of the courts of the Western Cape Division, Cape Town, South Africa. We nonetheless support the use of alternative dispute resolution before resorting to litigation.

14. Changes to These Terms

We reserve the right to amend these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Continued use of the Website or placement of an order after such changes constitutes your acceptance of the revised Terms. You are encouraged to review this page periodically.
